These Terms of Service ("Terms") govern your use of the Fretnaught mobile application ("the app", "Fretnaught"). By installing or using Fretnaught, you agree to these Terms. If you do not agree, do not install or use the app.
Fretnaught is operated by Blayne Robinson, a sole proprietor located in Ontario, Canada.
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Fretnaught on devices that you own or control, solely for your personal, non-commercial use, subject to these Terms and to the applicable app store's terms of service.
You may not:
The app's source code, visual design, written copy, curated chord library, organisation, and overall presentation are the intellectual property of Blayne Robinson, except for third-party open-source components used under their respective licences. A complete list of third-party components and their licences is available within the app under Settings → Open-source licenses.
The names of musical chords, scales, fingerings, intervals, and progressions themselves are public-domain musical knowledge and are not claimed as proprietary.
Fretnaught is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
You are responsible for verifying any musical information for your own use, especially for performance, recording, or instructional purposes.
To the maximum extent permitted by applicable law, in no event shall Blayne Robinson be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of, or inability to use, the app — even if advised of the possibility of such damages.
Our total cumulative liability for any direct damages arising from these Terms or your use of the app shall not exceed the greater of (a) the amount you paid for the app in the twelve months preceding the claim, or (b) ten Canadian dollars (CAD $10).
Any donation made via a link provided in the app is entirely voluntary. Donations:
We make no representation that any specific outcome will result from your donation.
We may update, modify, or change the app at any time, with or without notice. We may discontinue the app or any of its features without notice. We have no obligation to maintain backward compatibility, support specific devices, or release updates.
You may stop using the app at any time by uninstalling it from your device. We may terminate or suspend your licence to use the app immediately, without notice, if you violate these Terms.
Upon termination, the licence granted in Section 1 ends, but the disclaimer of warranties (Section 3), limitation of liability (Section 4), and governing law (Section 8) provisions survive.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the applicable laws of Canada, without regard to conflict-of-law principles.
Any dispute arising out of or in connection with these Terms or the app shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
We may revise these Terms from time to time. The most current version will always be reflected in the in-app links to this document and at the URL where it is hosted. Your continued use of the app following any changes constitutes acceptance of the revised Terms.
